Belasco Associates were engaged by a Tier 1 Contractor involved in the design and construction of a replacement Sewage Treatment Works (STW) in Jersey to manage the account of one of their major civil and M&E Subcontractors. The Subcontractor was appointed under an ECC NEC Option A contract (lump sum with activity schedule) and our services included the following:

  • Managing Subcontractor Early Warnings
  • Managing the Subcontract Risk Register
  • Assessment, valuation and submission of Compensation Events, up and down the contractual chain
  • Advising the Client on matters relating to extension of time, delay and mitigation
  • Assessment of Subcontractor extensions of time
  • Assessment of Subcontractor loss and expense
  • Advising on potential adjudication strategy and
  • Advising the Client on potential termination of the Subcontractor for breach of contract

    YATELEY CARE VILLAGE, HAMPSHIRE

    Client: Tier 1 Contractor | Sector: Residential, Healthcare | Value: £18,200,000.00

    Belasco Associates were engaged by a Tier 1 Contractor to prepare two significant contractual and quantum meruit claims against their Employer under a JCT Design and Build Contract (JCT DB/2011) in relation to the construction of a Retirement Care Village in Hampshire, including:

    • Forensic project, programme and time analysis of a number of Employer-related delays
    • Multiple extension of time submissions for various Relevant Events and
    • Detailed loss and expense submissions including direct costs, prolongation, overheads and profit, inflation and interest

    Belasco Associates provided significant support to the Client’s legal representatives in respect of the following litigation proceedings, and were later appointed as the Client’s Party Representative in four consecutive adjudications between the Contractor and their Sub-Contractor regarding extensions of time, loss and expense, set-off and main-contractor discount deductions.

      PETROCHEMICAL FACILITY, MILFORD HAVEN

      Client: Tier 1 M&E Contractor | Sector: Oil and Gas | Value: £15,000,000.00

      Belasco Associates were engaged by a Tier 1 M&E Contractor to provide project quantity surveying and commercial management services in relation to the modernisation of a petrochemical facility in Milford Haven, Wales. The contract was a bespoke contract, administered on behalf of the Employer by a Construction Manager. Our services included the following:

      • Preparation and submission of interim valuations
      • Assessment and submission of variations
      • Preparation of extensions of time and loss and expense claims for delays
      • Preparation of multiple subcontracts for mechanical, electrical and process works including stepping-down main contract terms and negotiation and agreement of terms and conditions
      • Assessment of subcontractor valuations and payment certification
      • Assessment of subcontractor variations
      • Assessment of subcontractor extension of time and loss and expense claims
      • Party Representative between Client and major subcontractor in 5 consecutive adjudications regarding the variation account of 600+ variations, multiple extensions of time and loss and expense
      • Project commercial management including procurement, cost reporting and cash flow analysis.
